We recently reported that the district court of Hamburg (judgment of 04.11.2016 - 315 O 396/15) had ruled that the eBay sale ban by Forever Living Products in a legal dispute represented by our law firm is lawful and, in particular, not contrary to antitrust law. The Hanseatic Higher Regional Court of Hamburg (judgment of 22.03.2018 - 3 U 250/16) has now confirmed our legal view and rejected the defendant's appeal.
The Court of Appeal also considers the eBay sale ban by Forever Living Products to be lawful and confirms that the platform ban takes place within the framework of an admissible and selective distribution system and that there is no violation of Article 101 AUEV.
